Terms of Service
Effective Date: February 22, 2026
Welcome to Baby Bird Blooms. By accessing our website or placing an order, you agree to the following Terms of Service, as well as our Shipping & Pickup Policy and Return & Refund Policy. Please read these terms carefully before making a purchase.
Summary of Terms of Service
We are a small Canadian flower farm with very limited inventory. Because of the seasonal and perishable nature of dahlia tubers, all sales are final and orders cannot be cancelled or modified once placed.
Tubers are grown on our farm, carefully inspected, and shipped dormant. Sprouting may take several weeks, and growth depends on environmental conditions beyond our control. We do our very best to maintain healthy stock and accurate labeling, but growing dahlias always carries some natural risk, including environmental factors and the possibility of dormant virus.
Pre-sale access, product limits, and sale-day procedures are designed to give as many people as possible a fair opportunity to purchase. By placing an order, you agree to the full Terms of Service below.
If you ever have concerns, please reach out directly — we are always happy to offer growing guidance and support.
Thank you for supporting a small, family-run Canadian farm.
Full Terms of Service
1. Order Placement
All orders must be placed through our website. We do not accept orders by mail, email, telephone, or social media.
Items placed in your cart are not reserved. Inventory is secured only once checkout is completed and you receive an order confirmation email.
Due to limited quantities, certain cultivars may have purchase limits per household. These limits are in place to allow broader access to select varieties.
2. Order Finality & Cancellations
All sales are final.
Due to the limited and seasonal nature of our inventory, orders cannot be cancelled, modified, combined, or refunded once checkout has been completed. This applies to both shipped and local pickup orders.
Please review your cart carefully before submitting your order. We are unable to make exceptions for accidental purchases, duplicate orders, address changes, or changes of mind.
By completing your purchase, you acknowledge and agree to this policy.
3. Pre-Sale Access
Customers who make a purchase during a sales season may be eligible for limited pre-sale access in a future season. Pre-sale access:
- Is granted at our discretion
- May be time-limited
- Is non-transferable
- Does not guarantee product availability
Items are not reserved during pre-sale windows until checkout is completed, and an order confirmation is issued.
Baby Bird Blooms reserves the right to modify or discontinue any pre-sale program at any time.
4. Sale Launch & Website Availability
Prior to a scheduled sale, products may display as “Sold Out” on the website until the official launch date and time.
Inventory may be temporarily removed before launch to prepare for accurate upload. Products will reappear at the stated launch time in Mountain Standard Time (MST).
We are unable to hold or reserve items prior to the official sale opening.
5. Product Information
All dahlia tubers are sold as single divisions (one individual tuber, not a clump).
Our tubers are grown on our farm for a minimum of one full growing season before being offered for sale. Tubers are stored in cold conditions and are typically dormant at the time of shipping. Visible eyes or sprouts may be small or difficult to see upon arrival. Each tuber is inspected during division and again prior to shipping to confirm viability.
Dahlias require warm soil temperatures (approximately 15°C or higher) to break dormancy. Sprouting may take up to 8 weeks depending on growing conditions. Baby Bird Blooms is a small-scale grower and does not pre-sprout tubers prior to shipping or pickup.
6. Natural Variation
Dahlia tubers vary widely in shape and size. A tuber may be as small as a AAA battery or as large as a banana.
Size, shape, or cosmetic appearance of the tuber does not impact the vigor, health, or bloom performance of the plant, provided the tuber has an “eye” (a growth bud on the crown), an intact neck, and a firm body (slightly wrinkled is usually okay).
7. Growing Responsibility
Dahlias are living products and are dependent on many environmental factors beyond our control, including but not limited to:
- Storage conditions
- Soil health
- Watering practices
- Temperature fluctuations
- Pests and disease
- Weather conditions
By purchasing from Baby Bird Blooms, you acknowledge that growth, bloom performance, and overall plant health cannot be guaranteed after delivery.
Growing instructions provided with your order should be followed carefully.
8. Virus & Sanitation Practices
Research has shown that a high percentage of asymptomatic dahlia plants may carry dormant viruses. At Baby Bird Blooms, we:
- Monitor plant health throughout the season
- Remove and dispose of symptomatic plants
- Sanitize tools between plants and plant materials
- Practice careful hand-digging and division
- Isolate and grow out imported stock separately before offering tubers for sale
Imported tubers are quarantined and evaluated through a full growing cycle before being made available to customers.
Despite diligent and meticulous sanitation practices, no growing environment can be guaranteed virus-free. Viruses may also be transmitted by insects or environmental exposure. By purchasing, you acknowledge that dormant virus presence cannot be entirely ruled out and is an inherent risk of growing dahlias.
Refunds or replacements will not be issued for suspected virus symptoms.
9. Pricing & Availability
As a small grower, quantities are limited. In many cases, only one or two plants per variety are grown each season. We reserve the right to:
- Adjust pricing at any time
- Correct errors in product listings
- Cancel and refund orders due to inventory discrepancies
- Cancel and refund orders resulting from technical errors or system overselling
If an item becomes unavailable, you will be notified and refunded promptly.
10. Payments & Chargebacks
All payments are processed securely through third-party payment providers via our website.
By completing a purchase, you agree to our Shipping & Pickup Policy, Return & Refund Policy, and these Terms of Service.
Fraudulent chargebacks or payment disputes for orders that have been shipped and delivered will be formally contested using:
- Order confirmation records
- Shipping confirmation
- Delivery confirmation or documented pickup acknowledgment
- Policy acknowledgment
Baby Bird Blooms reserves the right to refuse future service to customers who initiate fraudulent disputes.
